1. User information
Information such as email and contact numbers is our way of communicating with the user , so the user is required to enter his true information during registration. HosTYR has no responsibility for any Problems caused by incorrect user information.
2. Financial Arrangements
The user can request the cancellation of the service and refund up to 30 days after the order of the hosting service. (aside from disablement for Terms of Service or Spam Policy violations)
“30-Day Money-Back Guarantee” offer only applicable to credit card payments for hosting services.
Customer agrees that all charges and fees associated with an account are their sole responsibility.
Violations of HosTYR’s Terms of Service, Acceptable Use Policy, or Spam Policy may, at HosTYR’s discretion, result in immediate and permanent disablement without refund.
Any financial violations committed by the end users , will cause immediate and permanent blocking of the user account.
The return of money is for hosting services only can be reviewed and accepted.
Services with domain, SSL certificate and etc. , are free , in case of cancellation of the services , the cost of the mentioned items is deducted from the amount paid and the remaining cost is returned to the user.
Domain registration does not involve any return policy in any circumstances. domain registration fee can not be refunded.
The cost of the add-on provided by HosTYR is not refundable.
Any damage that the user enters to the HosTYR and confirmed , must be compensated by the user.
The possibility of returning expenses in case of damages to HosTYR to any kind including DDOS attack, Hack, overuse of resources, etc., can not be done.
If there are basic and insoluble problems in the service, the user can cancel the service by providing documentation and approval by the technical unit and the cost of using the service is deducted from the total cost and returned to the user.(Unavailability that is a result of Data Center problems or scheduled repairs is excluded from these conditions and not related to HosTYR.)
HosTYR Web Hosting shall not be liable for any taxes or other fees to be paid in accordance with or related to purchases made from Customer or HosTYR Web Hosting’s server.
Customer agrees to take full responsibility for all taxes and fees of any nature associated with such products sold.
If provided on the services tax is calculated, the user must pay the tax for to use the service and you are responsible for all taxes levied on the Services.
4.Trademarks & Copyrights
Customer warrants that it has the right to use the trademarks and copyrights applicable to all content and/or products being made available through the customer’s account.
Response time is defined as the initial response recorded on the ticket, which provides the Customer with a status update and or response.
HosTYR agrees to provide anaverage guaranteed response time of 15 to 90 minutes depending on the support plans.
Refunds / credits will be provided at the sole discretion of HosTYR, if found to be in violation of terms listed.
Exceptions due to causes beyond the control of HosTYR will not be considered sufficient grounds for refunds / credits.
6.Payment Due Date Policy
A billing notice is sent to you 5 days prior to your payment due date. Please settle your account/s on or before your due date. There is a 24 hour grace period after payment due date for you to settle your account/s. After the 24 hour grace period has elapsed and no payment has been received, your account will be suspended.
If any terms or conditions are failed to be followed it will result in grounds for account suspension or de-activation. HosTYR reserves the right to remove any account without prior notice. If HosTYR deactivates your account(s) for violating policy, you will forfeit your rights to a refund…and none will be given. No refunds for advance payments, on de-activated accounts. Normal policy is a warning first, and account de-activation the second offense. Serious offenses may cause immediate de-activation.
Any attempts to undermine or cause harm to a HosTYR server or customer of HosTYR is strictly prohibited. HosTYR will pursue legal action to the fullest extent for all abuse of the HosTYR Network.
9.Backups and Data Loss
For Shared Hosting Clients: Hosting services are regularly backed up. Although, we have this backup in place, it is recommended that you also have a personal backup of your files and data in case of a hardware failure of both the server and our backup. hostyr.Com is not responsible for files and data residing on your account. You agree to take full responsibility for files and data transferred and to maintain all appropriate backup of files and data stored on our servers.
For Dedicated Server and VPS Clients: You are responsible for your backup. If you ordered a server with secondary drive, it will be used for backup but it is also recommended that you get a remote backup in case of a hardware failure. hostyr.Com is not responsible for files and data residing on your server. You agree to take full responsibility for files and data transferred and to maintain all appropriate backup of files and data stored on your server.
The Customers indemnifies HosTYR and holds HosTYR harmless against any damages arising from any claims brought by The Customer or any other person against HosTYR from The Customers use of the HosTYR Service, The Customers negligence or The Customers breach of this agreement.
Except as provided by the contrary by Legislation The Customer acknowledges that HosTYR is not under any liability to The Customer in respect of any loss or damage which The Customer may suffer from the provision of the HosTYR Network or its inability to do so. In particular HosTYR accepts no liability for any loss of business, personal discomfort or any other damages arising from or alleged to have arisen from the loss of or non-provision of services to The Customer or any third party.
We specifically exclude any implied warranties from this Agreement. If by Legislation we are required to give a warranty as to services then The Customer agrees that our liability for any breach of such warranty is limited to
• the supply of the HosTYR Service again; or
• the payment of cost of having the HosTYR Service supplied again.
11.Disclaimer of Warranties
SUBSCRIBER ACKNOWLEDGES THAT THE SERVICES ARE PROVIDED AND; AS IS, AS AVAILABLE AND WITHOUT ANY WARRANTY OF ANY KIND. HEYSUPPORT HEREBY DISCLAIMS ALL WARRANTIES (EXPRESS, IMPLIED AND STATUTORY), INCLUDING WITHOUT LIMITATION, ALL WARRANTIES (A) WITH RESPECT TO THE SERVICES (INCLUDING WITHOUT LIMITATION THEIR QUALITY, AVAILABILITY, PERFORMANCE, FUNCTIONALITY AND COMPATIBILITY WITH ANY OTHER SERVICE OR PRODUCT), (B) WITH RESPECT TO THE QUALITY OR ACCURACY OF ANY INFORMATION OBTAINED FROM OR AVAILABLE THROUGH USE OF THE SERVICES, (C) THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS, (D) OF NON-INFRINGEMENT, (E) OF MERCHANTABILITY AND (F) OF FITNESS FOR A PARTICULAR PURPOSE. NO ADVICE OR INFORMATION GIVEN BY COMPANY OR COMPANY AND REPRESENTATIVES SHALL CREATE A WARRANTY.
12.Revision Of Terms Of Service
HosTYR reserves the right to change the Terms of Service at any time, without any form of notice to our, non-clients, or the general public.
It is the customer’s responsibility to check these Terms of Service from time to time for such changes.
